Court releases truck driver implicated in Ksh 7.5M drugs theft

A truck driver accused of stealing goods worthy Ksh 7.5 million has been released by a Nakuru Court for lack of evidence.

State Prosecutor Sandra Kosgei told the court that after scrutinizing the file, she realized that the flying squad officers were still investigating three suspects accused of being involved in the incident and the allegations that the driver of the truck was also involved in theft were invalid.

The prosecution comes up after the three suspects pleaded not guilty to the incident and denied all the charges that had been leveled against them.

Ismael Hussein, jointly with three others, were accused of stealing four drums of cocolethenomide drugs valued at Ksh 180,000,a total of 60 cartoons of self adhesive labels rolls valued at Ksh 170,000, another 117 rolls of plain wrappers label valued at Ksh 1.5 million, 303 cartoon of medicine valued at Ksh 2.8 million and 151 cartoons of veterinary medicine valued at Ksh 2.8 million.

The Prosecutor said that the driver was not in company of three other suspects on 28th November 2015 when the goods were stolen from a a lorry at Salgaa in Nakuru County.

Chief Magistrate Doreen Mulekyo applauded the prosecution team for the move and the efforts made in establishing those involved, hence saving the driver who may have suffered for an act he did not commit.

Mulekyo withdrew the charges under Section 87 of the Constitution and ordered the driver to be released and further directed his employee not sack him.
