Court stops all NSSF Board meetings over Atwoli case

A court has stopped all National Social Security Fund (NSSF) Board meetings until a case filed by Francis Atwoli is heard and determined.

The Central Organisation Trade Union (COTU) secretary general sued Labour CS Ukur Yatani for failing to re-appoint him to the Board of Trustees.

‘The purported failure to re-appoint and gazette the nominee of the Ex-Parte Applicant is riddled with illegality laced with malice and bad faith and is tailored to achieve an unlawful and illegal state of affairs which is wholly incompatible with the provisions of the NSSF Act, 2013 and the Constitution of Kenya 2010,” court documents read.

Atwoli’s lawyer cited Section 6(d) (ii) of the NSSF Act No. 45 of 2013.

The ruling comes two days after Justice Onsemus Makau ordered parties to file their responses on the same.

In July this year, the board wars between COTU and NSSF made headlines yet again after Atwoli went to court accusing the Labour CS of failing to appoint one of his nominees.

The COTU boss accused Yatani of frustrating Damaris Wanjiru Muhika.
