Court stops disbandment of Baringo County Assembly service board

The High Court in Nakuru on Friday issued orders barring the disbandment of Baringo County Assembly Service Board.

In the ruling, Justice Monica Mbaru stopped the resolution to disband the board pending inter party hearing on December 5, 2018 further directing all board members to go back to office until the matter is determined.

The ruling comes after four board members moved to court to challenge their removal from office.

Through their lawyers, the four argued that due process was not followed in their removal adding that their constitutional rights were violated as they were not accorded a fair hearing.

The four noted that the allegations raised against them were serious and it is a requirement they be heard before any action is taken against them.

A motion to disband the board was passed on Tuesday, November 14, 2018 and members agreed to elect a new board.

According to the MCAs, the board had failed in the management of the County Assembly affairs, citing salary delays, lack of airtime and cash for fuel.

Over 40 MCAs voted for the disbandment terming it as immoral and incompetent.
