Court stops SRC from reducing MCAs salaries

High Court judge Chacha Mwita on Tuesday stopped the Salaries and Remuneration Commission (SRC) from effecting the pay cut of Members of County Assemblies pending hearing and determination of the case by MCA’s challenging the Gazette Notice by SRC which reduces the remuneration and benefits for state officers in the County Governments.

The order has been issued after Members of County Assembly moved to court seeking to stop SRC from capping their pay.

In the case, the County Assemblies members want the High Court to suspend the implementation of the SRC decision, claiming it is “unreasonable and ignored relevant considerations.”

They argue that the Gazette Notice is “discriminatory, malicious, arbitrary and goes against their legitimate expectations.”

The MCAs claim that the said decision has negatively affected the effective functioning of the 47 County Assemblies and County Governments in performing the functions necessary for the implementation of devolution.

They argue that SRC ignored the mandatory provision which requires a cause to be conducted on the prevailing economic situation and a comprehensive job evaluation and that it made determination that is in excess to its jurisdiction.

“The decision of SRC to reduce and abolish the remuneration and benefits of the state officers in county assemblies and retain similar remuneration and benefits of other state officers is discriminatory and contrary to Article 27 of the constitution,” claimed the Society’s Secretary General Eric Mwangi in court documents.

The MCA’s claim that they have engaged SRC since the publication of the gazette notice to have it reversed without success rendering this action necessary.

They argue that replacing the mileage allowance with a fixed monthly transport allowance payable through payroll is not workable.

According to the MCA’s, the said decision continues to curtail ,deny and take way the rights and entitlements to annual salary increment ,mortgage ,transport and other facilities and benefits for the affected state officers serving the 47 county assemblies.

SRC did away with the MCAs’ sitting allowances, car grants and reduced allowances, which included mileage allowances.

In the suit, MCAs argue that their predecessors got better the perks, which they should also enjoy.
