Court Suspends Muthama, Ndemo Fraud Case

In her ruling, Nairobi principal magistrate Doreen Mulekyo said Muthama, Ndemo and the others were charged on 5th September, a day after they obtained a high court order barring their prosecution.

Mulekyo says the prosecution failed to disclose to the accused persons their order had been granted leading to their charging before the court hence rendering the process invalid.

The magistrate has further directed the matter be resolved at the high court first before she can proceed.

A hearing set for 29th September, 2014 will deliberate on the matter.
