Court suspends revocation of Muthamas gun certificate

High Court Judge George Odunga on Friday February 9, prohibited the government from revoking former Machakos senator Johnston Muthama’s firearm certificate.

In his ruling, Judge Odunga also directed that the matter be mentioned on 13th of this month for further directions.

“Leave so granted by this court do act as a stay of the revocation of firearm certificate no.002754 pending hearing and determination of the substantive motion,” ruled justice Odunga

The ruling comes after Muthama alongside Dagoretti North MP Simba Arati moved to court to challenge the decision by the Firearm Licensing Board to revoke their firearm certificates.

Muthama had filed an application under certificate of urgency claiming that no notification was issued and he was not accorded an opportunity to be heard.

In the notice dated January 30, the MPs had until the end of the day on February 1 to surrender their firearms.

“In accordance with the Provisions of the Firearms Act Cap 114, your Firearm Certificate No 10242 issued to you on November 12, 2015 is with effect from the date of this notice revoked as the board is satisfied that the revocation is warranted for reasons that you are unfit to be entrusted with a firearm any more,” read the notice issued by the board.
