Court temporarily STOPS expulsion of Mutua from Wiper

Machakos Governor, Dr Alfred Mutua, got a temporary reprieve after the Political Parties Tribunal suspended a decision by Wiper Democratic Movement expelling from him from the party.

This is after Mutua and six others lodged a petition before The tribunal challenging their expulsion.

The six, through lawyer Kioko Kilukumi, said the move by the National Delegates Conference (NDC) was illegal and an affront to Article 24 (2) (a) of the Constitution of Kenya 2010.

The Tribunal heard that the Political Party’s Constitution is inconsistent with Article 24(2)(a) of the Constitution of Kenya 2010 and should not be used to take any disciplinary action against the six.

“The 2016 Constitution which the Wiper Party Disciplinary Committee relied on to pronounce the expulsion of the six who had decamped has not been Gazetted,” argued Lawyer Kilukumi.

The applicants were directed to serve the respondents and appear for the inter-party hearing on January 8, 2017.

The NDC held its meeting on December 13, 2016 and ratified the expulsion of the six.

The six are Dr Mutua, MPs Regina Ndambuki (Kilome), Richard Makenga (Kaiti), Kisoi Munyao (Mbooni), John Munuve (Mwingi North) and Joe Mutambu (Mwingi Central).
