Court throws out criminal charges against ex-CS Michael Kamau

The Court of Appeal has quashed criminal charges against former Transport Cabinet Secretary, Eng.Michael Kamau.

In their ruling, Judges Milton Makhandia, William Ouko and Kathurima M’Inoti ruled that the Ethics and Anti-Corruption Commission (EACC) was not properly constituted by the time it was forwarding the names to the Director of Public Prosecutions (DPP) for prosecution.

The trial court also heard that the Court of Appeal Judges allowed the appeal by Eng. Kamau and set aside orders set by the High Court.

In his appeal, Kamau argued that EACC lacked the necessary quorum to recommend charges against him.

In June 2015, the former CS was charged with abuse of office and failure to follow with the procurement laws.

The former CS pleaded not guilty and was released on a Ksh 1 million cash bail.

Eng. Kamau has, however, been temporarily moved to the Court of Appeal to challenge the corruption charges leveled against him.
