Court vacates order stopping burial of ex-MP Mark Too

The High Court sitting in Eldoret has vacated an order it had issued stopping the burial of former Member of Parliament Mark Too.

On Monday, January 9, the High Court lifted an order that was issued temporarily halting the burial of the KANU regime MP.

Simon Lilan, an lawyer, had petition the court to stop the burial of the former nominated MP until a second post mortem is conducted to establish the cause of his death.

In his petition, lawyer Lilan, wanted an independent autopsy carried out arguing that there was a probability of sample mishandling during the first one.

Resident Magistrate, Nicodemus Moseti, vacated the order but said the case will be heard on Thursday, January 12.

The politician, famously known as Bwana Dawa for his ability to fix political disputes, died on December 31 last year after reportedly collapsing in the bathroom.
