Courtroom drama, moment of shock in case against Babu Owinos win

A witness in the petition challenging the election of Embakasi East MP Babu Owino found himself in a foot-in-mouth situation on Thursday, after a video clip was played in court showing  that he was among a group of goons that disrupted the election in one of the polling stations.

Samuel Ayub, who was a Jubilee agent in the election and is one of the witnesses brought by the petitioner, Jubilee’s Francis Mureithi, was shocked to see himself among goons despite earlier on testifying how ODM’s Babu hired hooligans who threw stones in a polling station in the constituency during the August 8 poll.

Though he did not deny being in the video, Ayub remained tight-lipped as he could not explain how he found himself in the crowd yet he had earlier told the court that at the time of the fracas he was manning a stream in a voting hall.

Another witness, Jane Wandayi, who was a Jubilee agent in one of the polling stations in Embakasi East, caused a scene in the courtroom after she demanded to interrogate Babu Owino’s advocate, Jackson Awele, who according to her, had asked her a plethora of questions without permitting her to also ask questions.

“Your honor why is he asking me many questions yet he doesn’t give me a chance to ask him my questions,” Ms Andayi shouted as a section of the courtroom burst in laughter.

Amid the laughter, Justice Joseph Sergon intervened and informed the witness that her mandate for the day was to answer questions and not to ask.

One of the questions that seemingly pissed off Ms Wanadayi was why she signed a form in which a candidate she was representing got zero and later came to disown the document in court.

Another agent complained that results in a polling station he manned were not presented in forms accurately, further telling the court that Babu Owino never attacked his ANC opponent Mr. Joshua Obiende who in his testimony claimed he was assaulted.

In the petition, Babu Owino has been accused of interfering with the election process rendering its outcome unconstitutional. The court has so far heard testimonies from five witnesses. The hearing continues.
