Courts stops TSC from suspending 221 teachers over new curriculum

The High Court on Thursday temporarily stopped the Teachers Service Commission (TSC) from proceeding with any disciplinary action against 221 teachers who boycotted the training on the new Competency-Based Curriculum (CBC).

On Tuesday last week, TSC sent show cause letters to about 160 teachers for boycotting/disrupting the CBC training last month.

Justice Byram Ongaya, however, suspended the disciplinary action following a case filed by the Kenya National Union of Teachers (KNUT) which argues that TSC’s action was unfair and unreasonable.

KNUT has continuously stood its ground against implementation of the new curriculum claiming it was being conducted unlawfully.

“The law requires an exercise of such a magnitude to have guidelines and a gazetted commission to anchor the entire process… Besides, the due process of reforming the content of the curriculum was never followed to the letter, hence making the entire exercise illegal,” said Sossion in a statement last month.

Education Cabinet Secretary Prof. George Magoha on Wednesday told off those opposing the implementation of the new curriculum, asserting that the government will not be deterred by critics.

Speaking during the unveiling of the new curriculum policy, Prof. Magoha said instead of calling for a recall of the implementation of the new curriculum, the critics should be offering solutions.

“If you give birth to a premature child do you say let the child go back to the womb? You take the child to the incubator and the child grows big and becomes the president of Kenya. Stop this nonsense,” said Magoha.

“If you have something better why don’t you tell us what it is, or shut up. The God of the poor shall deliver this curriculum to Kenyans. Irrespective of a few ill guided people who want to take it away from Kenyans.”
