CS Anne Waiguru to record statement over NYS money theft

The Director of Public Prosecutions (DPP) Keriako Tobiko has asked Devolution Cabinet Secretary Anne Waiguru to record a statement over the theft of Ksh 791,385,000 and conspiracy to steal a sum of Ksh 695,450,000 from the National Youth Service (NYS).

In a statement sent to newsrooms, Tobiko noted that several aspects of the fraud case fell under the Ethics and Anti-Corruption Commission (EACC) and directed that the EACC be invited to join the prosecution team to participate in the review of the file in order to determine matters falling under its legal mandate.

Tobiko stated that he had received an inquiry file into the alleged fraudulent transactions from the Director of Criminal Investigations and that a team of prosecutors was currently reviewing the file and the review is ongoing.

“Given the nature, complexity and magnitude of this investigation, the CID investigation team has done a commendable job,” read the statement.

“The investigation carried out by the CID is limited only to offences under the Penal Code. However, the evidence in the file discloses possible offences under Proceeds of Crime and Anti-Money Laundering Act and the Prevention of Organized Crimes Act. These offences have not been investigated.”

Tobiko noted that from the evidence, huge deposits were made to and withdrawals made from bank accounts belonging to several suspect companies and individuals.

“All these accounts are domiciled in Family Bank, KTDA Branch. It is not clear from the file how such huge deposits and withdrawals could have been made without the suspect transactions being reports to the Financial Reporting Centre (FRC) or the Central Bank of Kenya (CBK),” further read the statement.

Furthermore, according to the DPP, of the 22 government officials recommended to be charged by the DCI, only two have been interrogated and have recorded statements as suspects. The others, according to Tobiko, have recorded statements as potential prosecution witnesses.

The NYS had in recent weeks been put on the spot over alleged corruption in some of its flagship projects in the country.

The fiasco stemmed from a letter from the Central Bank of Kenya to the Devolution Ministry questioning hurried payments of hundreds of millions of shillings to private companies through NYS.
