Death Sentence for Baragoi Massacre Suspects

The two were proved guilty of robbery with violence and being in possession of dangerous weapons valued at 150,000 shillings.

Eriuan Elkayo was found with G3 rifle, Paul Ekutan was found with 20 rounds of ammunition all belonging to the government of Kenya while Ewoi Losike was found with a G3 rifle.

Senior resident magistrate Benson Khapoya found 21 year old Paul Ekuton and 19 year old Eurian Elkayo guilty as charged and sentenced them to death.

The Magistrate however withheld judgment for 16 year old Ewoi Lesike since he is a minor and his judgment will be delivered on the October 23, 2014.

According to the prosecution, the firearms found on the accused had been assigned to three police officers: the late Police constables Benson Kangeretho, Antony Ouma and Eric Mutwiri respectively on November 11, 2012 at Lomerok in Samburu North Sub County within Samburu County.

It is in search of justice that the Maralal court has found two of the herds men guilty and sentenced them to death.

In mitigation, the two asked the court for leniency saying they had heavy family duties to attend to.

According to the resident magistrate Khapoya  the gravity of the offence where the lives of 40 police officers were lost  dealt a big blow to the nation adding that the two deserved the sentence.
