Deported Miguna sues government, wants return to Kenya

Politician Miguna Miguna has filed a case at the High Court in Nairobi challenging his deportation to Canada and revocation of his citizenship by the government.

Miguna, who has sued the government, wants the court to suspend the government declaration that he was not a Kenyan and that his presence in Kenya was “contrary to the national interest and should be removed from Kenya to his country of origin Canada.”

He also wants the court to grant an order suspending the gazette notice proscribing the National Resistance Movement (NRM) as a criminal organisation.

In the case filed at the Milimani Law Courts, Miguna wants the court to order the government to reinstate his passport and avail it to him.

The self-declared NRM general also sought orders to allow him gain re-entry into Kenya.

Through lawyer John Khaminwa, Miguna says that the conduct of the respondents in the case requires immediate action by the court to return him in Kenya. Khaminwa argues that the purported deportation was unconstitutional, unlawful invalid, null and void.

“The two declarations dated 6th February, 2018 by the 1st respondents should be suspended forthwith to enable the petitioner to return to Kenya and defend himself and eventually be quashed upon the hearing and determination of this petition,” reads the petition.

In the petition, Khaminwa says Miguna is entitled to return into the country without any further delay and respond to allegations leveled against him before the chief magistrate court in Kajiado.

“The petitioner therefore prays for the urgent intervention of this court in order to arrest the continuing violations of his constitutional rights and to mitigate against the continuing irreversible prejudice he is suffering as a result of the illegal actions by the respondents,” reads the petition.

CS Fred Matiangi, Director of Immigration Dr.Gordon Kihalangwa, Inspector General of police Joseph Boinnet, DCI George Kinoti and officer in charge of Flying squad Said Kiprotich have been named as respondents.

Also named as respondents in the matter is Officer Commanding Police Division JKIA and the Attorney General.
