DPP appeals Pastor Nganga acquittal in accident case

DPP appeals Pastor Nganga acquittal in accident case

The Director of Public Prosecutions has filed an appeal challenging the acquittal of Pastor James Ng’ang’a of Neno Evangelism in a case where he was charged with causing the death of a woman in a fatal car crash.

In a statement issued on Tuesday, the DPP said the appeal had been filed at the Kiambu High Court.

“The has today filed Criminal Appeal No. 34 of 2018 at the Kiambu High Court in relation to the acquittal of Apostle Ng’ang’a and four others by a Limuru Magistrate’s Court,” said the DPP’s office.

Pastor Ng’ang’a and his co-accused were facing four charges, chief among them, causing death by dangerous driving.

Chief Magistrate Godfrey Oduor, however, dismissed the case on May 4 this year saying the prosecution failed to place the clergyman at the scene of the accident.

According to Magistrate Oduor, it could not be ascertained that Pastor Ng’ang’a was driving the car during the fatal crash at Manguo area in Limuru on July 26, 2015.

However, the Office of the DPP termed the acquittal of Pastor Ng’ang’a as erroneous, saying the magistrate acquitted the pastor without giving reasons why.
