DPP complains about Jimi Wanjigis bail

The Director of public prosecution now wants the court to adjust anticipatory bail terms granted to business man Jimmy Wanjigi in October.

Through his advocate and in reference to an affidavit sworn by chief inspector Josphat Gichuki, the DPP complains that the amount granted to Wanjigi is way below the magnitude of the offense being investigated against him.

The DPP also sought the court to direct Wanjigi never to leave the country without getting permission from the police and or the court pending completion of the investigations.

Further, DPP asked the court to direct that the businessman deposit more documents in court as surety that he will be within the court jurisdiction until the investigations are done.

The application has since been opposed by Wanjigi’s advocate Julie Soweto who termed it as insincere since the police have never questioned Wanjigi or carried on with the alleged investigations from the time they raided his house and destroyed property.

Soweto, who was before Justice Chacha Mwita said the police are only mischievous and claim that they are investigating Wanjigi in relation to possession of legal firearms is untrue.

The counsel further added that the application is only meant to curtail Wanjigi’s freedom of movement and subject him to oppression.

The orders have since been extended until further directions by court.

The court had in October protracted Wanjigi from the police harassment through a KSh.50,000 anticipatory bail.

The court will rule on the application on 31st January 2017.

This even as the AG was named as a principal respondent in the matter in an amended petition.
