DPP Noordin Haji accuses Judiciary of shielding errant judges

Director of Public Prosecutions (DPP) Noordin Haji on Saturday accused the Judiciary of shielding errant judges and magistrates from punishment for crimes committed.

DPP Haji, while addressing a press conference, spoke in reference to the quashing of criminal charges against Mombasa Principal Magistrate Edgar Kagoni over the loss of heroine exhibits worth Ksh.30 million.

Haji faulted the Judiciary for condoning acts of impunity involving its staff members.

Malindi Resident Judge Reuben Nyakundi, while dismissing the charges against Magistrate Kagoni, also ordered Haji and Director of Criminal Investigations (DCI) George Kinoti to pay Kagoni Ksh.2 million as damages for infringing on his rights.

“If the Judiciary says they cannot be investigated, then police officers and governors and other officials will also say the same thing…how would that work? Yet someone broke the law and we have evidence that it was criminal,” wondered Haji.

“Drugs vanished, and this magistrate knew clearly that drugs cannot be stored in a courtroom…drugs, weapons, guns and bombs are supposed to be placed in police strong rooms. That is the law.”

He further added: “We have evidence that the magistrate did that intentionally so that the drugs can be stolen. That is the evidence we want to present before court, so why should we be blocked from doing it?”
