DPP okays prosecution of former NYS Director General Nelson Githinji

The Director of Public Prosecutions Keriako Tobiko has recommended the prosecution of former National Youth Service (NYS) Director General Nelson Githinji for abuse of office and other criminal charges.

The DPP, through a statement to the newsrooms, said that the investigations by the Ethics and Anti-Corruption Commission (EACC) presented sufficient evidence to charge Githinji.

The former NYS boss is charged alongside his Aide de Camp Nicholas Juma Makokha and the Senior Superintendent of Mechanics at NYS Geoffrey Kimani Kiriha.

Githinji is accused of maintaining his privately owned vehicle, Reg No. KBS 475S, at a cost of Ksh 497,335 paid by the NYS.

The DPP has directed that prosecution of the three commences immediately.

Githinji is also facing other charges including fraud and attempt to defraud the government through irregular procurement processes.

On November 16th, 2015, the DPP ordered the prosecution of Githinji alongside Devolution PS Eng. Peter Mangiti and businessman Benson Muchemi over allegations of fraud at NYS.

Tobiko accused the three of tampering with a public officer by trying to prevent NYS Senior Deputy Director General in Charge of Administration, Adan Harakhe, from reporting the loss of Ksh 695,400,000 to the Directorate of Criminal Investigations.

The DPP also accused the three of threatening and intimidating Harakhe with unspecified consequences if he proceeded to withdraw from the Integrated Financial Management Information System (IFMIS).

At the same time, the DPP has cleared Mombasa Governor Ali Hassan Joho of claims that he facilitated the irregular allocation of Mwembe Tayari Public Market in the coastal city to a Mr. Mohammed Abdullah Zubedi and a Mr. Abdulhakim Abdullah Zubedi.

The DPP said that upon review of the allegations by EACC, the anti-graft czar found no criminal culpability on the part of Joho to warrant prosecution.

Tobiko said that by the virtue of Mwembe Tayari being a public market, the County Government of Mombasa must ensure all the laws appertaining to lease are followed in the allocation process.
