DPP recommends Moses Kuria prosecution over incitement

Director of Public Prosecution (DPP) Keriako Tobiko on Monday recommended the prosecution of Gatundu South MP Moses Kuria over incitement to violence.

This was after receiving files from the National Cohesion and Integration Commission (NCIC) recommending Kuria’s prosecution for what the commission termed as “Inciting members of his constituency to cut those opposing national youth service programs with pangas.”

In a statement to newsrooms, the DPP indicated that he, upon review of the file, was satisfied that the evidence within was able to sustain the charges leveled against the legislator.

This comes barely two weeks after a Nairobi court dismissed an application by Gatundu South Member of Parliament Moses Kuria seeking it to compel Mobile Services Provider Safaricom to release to him phone records of the Law Society of Kenya CEO Apollo Mboya, who he accused of forwarding his name to the National Cohesion and Integration Commission (NCIC).

Kuria had told the court that he intended to use the phone records in his defence accusing Mboya of maliciously forwarding his name to NCIC over allegations of hate speech.

Mboya had testified that he had received calls from people complaining of Kuria’s tweets, something Kuria says is not true and the more reason why Safaricom should be compelled to release the phone records.

Earlier this year Kuria had been arraigned in court for making ethnic slurs on social media, and secured a Sh2 million cash bail but on condition that he ceases posting hate messages on Facebook.

The National Cohesion and Integration Commission, however, sought to have the bail terms cancelled after Kuria breached the conditions.

The National Alliance party (TNA) had also summoned the Gatundu South MP to the party’s disciplinary committee over the allegations.

Kuria was then grilled by the Directorate of Criminal Investigations (DCI) officers at the DCI headquarters over his remarks.
