DPP returns KEMSA investigation file back to EACC for further probe

The Director of Public Prosecutions Noordin Haji has returned the Kenya Medical Supplies Authority (KEMSA) file on alleged procurement irregularities to the Ethics and Anti Corruption Commission (EACC) for further investigations, before a final decision can be made on prosecuting six senior KEMSA  officials as recommended by the EACC.

President Uhuru Kenyatta had on August 26, given EACC 21 days to conclude investigations into alleged irregular procurement and fraudulent payments.

In a statement released on Friday, the DPP said that upon finalising reviewing files of the alleged beneficiaries, “it has emerged that the scope of the investigations is massive, with several witnesses, entities and thousands of documents to be examined.”

“The prosecution team will hold a joint meeting with the EACC investigators to adequately address the identified gaps on sufficiency of evidence,” the statement read in part.

The DPP further noted that he is yet to receive a Special Audit Report on the Utilization of Covid-19 Funds by KEMSA from the Auditor General Nancy Gathungu.
