DPP warns Waititu & Lenolkulal against opening parallel offices

DPP Noordin Haji has warned Governors Ferdinand Waititu and Moses Lenolkulal against opening parallel offices.

Speaking on Friday during a Press briefing, the DPP faulted the Senate for going against court orders.

“Korti ilisema hawa magavana wawili wasirudi ofisini lakini sasa mkono mwingine ambao hauna nguvu wa kuvunja hukumu la korti imefanya hivyo. Tujiulize sisi wakenya ni kwa ajili gani?” he said.

According to him, the judiciary is also at fault for allowing suspects in public office to defy orders and this goes against the Constitution.

He issued a warning to the Senate saying this should not me made the norm because it will also set a precedence for members of Parliament.

“Kesho kutwa utasikia pia polisi na jeshi wanafanya vile wanavyotaka,” the DPP added.

The DPP said leaders must let the prosecutorial system run its course so that suspects prove their innocence within the courtroom.

He said the onus is on them to prove that the Prosecution has no case but this can only be done in court and in reference to evidence provided.

The DPP said trying to stop a case or arrests ‘sio haki na wengine wataiga mtindo huo” and suspects who have shown this trend are cause for concern as they have no respect for the Constitution.

On Wednesday this week, Deputy Speaker Prof. Kithure Kindiki ruled that Waititu and Lenolkulal can continue carrying out their duties as governors only that they cannot access the county offices.

The Senate ruling comes in the face of a yet to be determined appeal by Waititu challenging a High Court ruling on his bail terms that barred him from accessing the office.
