Driver denies killing student as he fled from NTSA

A man accused of killing a university student while trying to evade an NTSA dragnet on January 30, 2016 on Friday denied the allegations of causing death by dangerous driving.

Job Nyongesa is a defendant in a criminal case where he is being accused of killing 21-year-old Brian Kaimbati.

“I was driving along Thika Road with my two friends, upon reaching GSU camp I saw a vehicle driving on the wrong side of the road and an accident occurred,” said Nyongesa.

Nyongesa told the court that he cannot recall the events that occurred after the accident saying that he only found himself in the hospital.

The prosecution allege that Nyongesa drove on the wrong side of the road and rammed into another vehicle that was being driven by the first year engineering student.

Earlier, Nyongesa’s application to have the case withdrawn on that the charge sheet was declined.

Through his lawyer John Khaminwa, he argued that the charge sheet presented by the prosecution bears his Christian names which he termed as unlawful since the state does not subscribe to any religious leanings.

He was released on a cash bail of Ksh.100,000 shillings.

The matter will be mentioned on January 18 when parties are expected to give out their final submissions before a judgment is delivered.
