EACC clears Kimemia, calls for prosecution of Geothermal Company MD Simiyu

The Ethics and Anti-Corruption Commission (EACC) has recommended the closure of an investigation file against former Secretary to the Cabinet Francis Kimemia.

The commission stated that there is no evidence to prove that Francis Kimemia allocated himself and his close relatives 31 government vehicles.

Kimemia is one of several government officials whose names featured in the infamous ‘EACC list of shame’ over allegations of corruption.

The list, which was tabled in Parliament in March this year by President Uhuru Kenyatta also mentioned five cabinet secretaries; Charity Ngilu (Lands), Felix Koskei (Agriculture), Michael Kamau (Transport), Davis Chirchir (Energy) and Kazungu Kambi (Labour).

All the five ministers have since been suspended.

The commission also called for the prosecution of Ngatia Ndungu, the Director of Redline Limited and Josephat Kipkoech Sirma, Chief Engineer over allegations of irregular payment of Ksh30 million to Redline Limited by Kenya Pipeline Company through their accounts for the supply, installation and commissioning of three autotransformers procured from Agecelec Industry of France.

Others that could face prosecution include Isiolo Governor Godana Doyo, the county’s deputy speaker David Lamantile, assistant clerk of the county assembly Boru Jirima and chairman of the Budget and Appropriation Committee Abdi Sora.

The four are accused of passing the irregular supplementary appropriation Act 2014 in December 2014.

Bomet County Executive member in charge of Health and Sanitation Dr Stanley Kiplagat Cheruiyot could also face prosecution over allegations of flouting procurement procures in the leasing of county ambulance services from KRCS – Emergency Plus Medical Services Ltd.

Geothermal Development Company Managing Director Silas Simiyu and Pradix N Saisi Company Secretary and Members of Tender Award committee namely Abraham Saat, Nicholas Weke, Peter Omenda, Godwin Mwawongo, Caleb Mbayi and Bruno Linyuri were also recommended for prosecution.

The recommendations have been forwarded to the Director of Public Prosecutions Keriako Tobiko for deliberations.

The new developments come a week after the DPP Tobiko ordered for the prosecution of five individuals over allegations of graft.

In a statement, Tobiko ordered the prosecution of former employee of the defunct Eldoret Municipal Council Nicholas Ngeno, Kenya Slum Upgrading Program (KENSUP) Project Manager Jackson Mutua, Fredrick Ojwang and Ruth Otanga over allegations of misappropriation of over Ksh28 million for uncompleted or undone work at the Langas Market.

The payment was made by Nicholas Ngeno (the now Kericho County Executive Member for Lands Housing and Physical Planning) for the project funded by KENSUP.

“EACC investigated the allegations and from the evidence recommended that Nicholas Ngeno, Jackson Mutua and Fredrick Ojwang and Ruth Otanga the directors of the company awarded the works be charge,” read the statement in part.

“Upon independent review of the file, the DPP is satisfied that the evidence is sufficient to sustain the recommended charges.”

Speaker of the Elgeyo Marakwet County Assembly Albert Kochei is also set to face prosecution for obtaining allowances in a deceitful manner.

Kochei is alleged to have obtained allowances purporting to have travelled to Atlanta Georgia in the United States, a trip that never was.
