EACC recovers Kenya Railways Ksh.35M Kisumu land

The Ethics and Anti-Corruption Commission (EACC) on Thursday won a case pitting Kenya Railways against two private investors over land in Kisumu valued at Ksh. 35million.

The case which was presented at the Environment and Land Court in Kisumu was presided over by Justice S. M. Kibunja.

Two private investors Okongo Oyoo and Sammy Komen Mwaita were claimed to have leased the land from the Kisumu County Government.

During the proceedings, EACC urged the court to cancel the lease under Kisumu Municipality/Block 7/542.

They also sought to have the Certificate of Lease that had been issued to one of the defendants revoked so that the land would be restored to Kenya Railways.

The Commission also asked the court for a permanent injunction against the first defendant, his agents, servants or representatives.

This they said would restrain them from leasing, transferring, charging, entering upon, developing, or in any other manner howsoever dealing with railways land.

EACC also called for the valuation of the property and that it be registered under the National Land Commission as ordered by the Court.

Earlier this year, Kenya Railways Corporation submitted to EACC close to 500 cases countrywide involving its parcels of land said to be illegally acquired by private investors.
