EACC threatens to sue Raila over failure to honour summons

The Ethics and Anti-Corruption Commission (EACC) has threatened to prosecute CORD leader Raila Odinga if he fails to honour summons to appear before it on Monday.

In a letter to the CORD leader, Chief Inspector Fredrick Mwangi, the officer commanding EACC Headquarters Police Station said there is reason to believe that Raila has information that may assist in his investigations of the Eurobond saga.

“In exercise of the powers conferred to me under Section 52 of the National Police Service Act No. 11A of 2011, I require you to attend before me at the EACC Headquarters Police Station on December 14, 2015 at 10am without fail for further directions,” said Mwangi.

“Be warned that failure to comply with the above requisition will render you liable to prosecution.”

Meanwhile, Raila Odinga reiterated his earlier stand that he will not appear before the Ethics and Anti-Corruption Commission.

In a statement, Raila’s spokesperson Denis Onyango said the ODM party leader had met four officials from the EACC who had come to sermon him to record a statement at the commission’s headquarters over the Eurobond loan.

Mr Odinga met the four officers in the presence of his lawyers Paul Mwangi, James Orengo, Moses Wetangula and T.J Kajwang.

The lawyers reportedly took issue with the “contemptuous and threatening” tone of the letter and questioned why the EACC has never found it necessary to record statements from Odinga from his offices when it has had occasion to send officers abroad to record statements.

Raila also took issue with the legitimacy of the commission as currently constituted, being without commissioners, saying he will not appear at the Integrity Centre, neither will he be compelled or intimidated into doing so.

The unfolding came hours after Raila made true his word not to appear before the commission on Thursday after he was summoned on Tuesday.
