Embu: Man admits to killing brother, dismisses further investigation as waste of time

A man on Tuesday shocked an Embu Court when he termed an application to have him detained for 10 more days pending investigations into the murder of his brother as “a waste of time” admitting that he committed the act.

Appearing before Senior Resident Magistrate Tony Kwambai, Samson Ndungu Maina declared himself guilty saying he was ready for the consequences and that there was no need for further investigations.

Through a sworn affidavit by Police Constable Joseph Wainaina, Embu West Director of Criminal Investigations (DCI) asked the court to grant him 10 working days to continue detaining the suspect as investigations continue.

Mr. Maina, however, asked the court not to grant the DCI’s prayers while shouting that he was the one who killed his brother; Patrick Kanyari Duncan.

The suspect is said to have locked his brother in a house on January 8, 2019 at 11p.m and assaulted him after which the deceased succumbed to his injuries while undergoing treatment at Embu Level Five Hospital.

In the affidavit, Constable Wainaina stated that the suspect committed the offence and fled to Nairobi where he has been in hiding until he was arrested on January 21, 2019 and booked at Kamukunji Police Station.

The officer also stated that the suspect was likely to interfere with their key witness, who is his mother, and that he was a flight risk hence should not be released on bond.

Magistrate Kwambai granted the application by the DCI and allowed the suspect to be detained at Embu Police Station to enable conclusion of investigations.

He further directed the investigators to produce the accused in court on February 4, 2019 to confirm if he is to be charged or otherwise.
