EPZ top seat to remain vacant as court restrains Munya

Trade Cabinet Secretary Peter Munya has been directed not to fill in the position of Export Processing Zone (EPZ) Chief Executive until a matter filed a former CEO Fanuel Odede Kidenda is heard and determined.

The court also directed that Kidenda be paid his salary for the month of September when he was sacked to this month.

The directions were issued by Employment and Labor Relations Court justice Hellen Wasilwa who said that the matter before her is a unique case since two CSs are fighting over the appointment of Kidenda.

“Pending hearing and determination of this case, court issues an order of injunction to seize from declaring the office vacant and recruiting the position of EPZ CEO,”said the judge.

In the case former chief executive Fanuel Odede Kidenda has sued Munya for firing him claiming that he was appointed by former Trade Cabinet Secretary Adan Mohammed in July this year for a term of three years.

Meanwhile the parties in the case have asked for more time to have the matter settled out of court.

The parties in a consent agreed to have the matter mentioned on the 6th of February 2019 for further directions.

In court papers, Kidenda has asked the court to quash the decision to sack him as it was without notice and “in total violation of labor laws.

Munya on his part claims that the letter of appointment issued to Kidenda was either forged or altered as the then CS Adan Mohamed was not in Kenya on 11-07-2018.

In a further affidavit, EPZ says that it has written a letter to the DCI to investigate the circumstances under which the contract of employment was issued to Kidenda.
