ERC, AG Kihara given 7 days to file responses in fuel levy case
The Energy Regulatory Commission (ERC) and the Attorney General have been given seven days to file their responses in a case challenging the Value Added Tax (V.A.T) on petroleum products.
High Court Judge Chacha Mwita directed the parties to file and serve their submissions before October 6, 2018 when the matter will be mentioned.
The Central Organisation of Trade Unions (COTU) has been enjoined in the case as an interested party whereas an application by Ondoa Panya Operation national coordinator John Wamagata seeking to be a second interested party was declined.
Activist Okiya Omtatah previously moved to court arguing that the levy on fuel products is irregular and unconstitutional.
The activist submitted that enforcement of the VAT on fuel was done in defiance of an express decision by Parliament to suspend its implementation.
