Ex-Govt pathologist in body organs scandal moves to high court

Former chief government pathologist Moses Njue has moved to the High Court seeking to stop criminal proceedings against him at the lower court.

“Pending the hearing and determination of this application an order to issue restraining the respondents from hearing, proceedings with conducting or in any manner proceedings the charges laid proceedings before the chief magistrate court,” reads the application.

According to Njue, there is another constitutional matter (Petition 201 of 2016) that touches on the same substantive matter, facts as the one at the chief magistrate court.

Njue says it will be taxing both financially and psychologically for him together with his co-accused person to have the said matters run concurrently.

“The petitioners are in dire need of this protection of the court failure to which his constitutional rights shall continue to be violated,” adds the application.

Njue has also faulted the police and the Directorate of Criminal Investigations (DCI) for commencing his prosecution two years after recording statements with the police.

The embattled pathologist claims the move is meant to embarrass, humiliate and coerce him.

Njue has previously denied stealing the heart of a corpse at Lee Funeral Home three years ago.

He was charged at a Nairobi court alongside his son, Lemuel Anasha Mureithi – who was his assistant pathologist.

They are accused of stealing the heart of Timothy Mwandi Muumbo while performing an autopsy on June 25, 2015.
