Njue, son, charged with stealing dead mans heart

Former Government pathologist Moses Njue has been arraigned in court and charged with stealing the heart of a deceased man.

On Tuesday, Njue was charged alongside his son Lemuel Anasha Mureithi Njue.

According to the charge sheet, the Prosecution alleged that Njue stole the heart that came to his possession as the pathologist in charge.

The incident is said to have occurred during a postmortem exercise of the late Timothy Mwandi Muumba on June 25, 2015.

Njue, who pleaded not guilty, also faces a second count of destroying evidence during the postmortem at Lee Funeral Home, Nairobi.

It is alleged that between June and September 2015, he destroyed the heart in question after stealing it knowing that it may be required as an evidence in judicial proceedings.

The accused, who was appearing before Nairobi Chief Magistrate Francis Andayi on Tuesday, also faces a third count of illegal removal of a body part.

Through his lawyers, the former pathologist told the court that the charges are related to a similar matter filed by the deceased family at the High Court.

He requested that the court defer the plea hearing to a later date. “The relationship between the two accused persons is father and son and therefore we will be asking the court to issue summons for the second accused person to appear in court.”

Gachokii was released on a cash bail of Ksh. 300,000 and directed not to interfere with witnesses in the case.
