Ex-KPA boss Daniel Manduku, co-accused Juma Fadhili to pay Ksh.12M cash bail each

Former Kenya Ports Authority (KPA) boss Daniel Manduku and Works officer Juma Fadhili have been freed on Ksh. 12million cash bail each.

This after they denied fraud charges in the Ksh. 244million corruption case at the authority.

“They shall deposit passports with the court. They shall not contact witnesses. The prosecution to furnish the defense with the materials to be used in the case,” Chief Magistrate ruled on Friday.

Earlier, the Prosecution had sought to have terms of bail or bond be proportionate to the case facing the accused persons.

They further urged the court to direct that the accused stay away from witnesses and deposit their passports with the court.

However, lawyer Nelson Havi who is representing Manduku argued that the first accused person is not a flight risk.

He also requested for reasonable bail and bond terms adding that Manduku is no longer in employment.

“He will not be in a position to raise a higher sum than the Ksh. 500,000 the high court had ordered as he has other obligations to his family. Everybody cash flow is now affected by the pandemic there no avenues of generating income,” Havi said.

On his part, Lawyer Eric Theuri who is representing Fadhili said: “We adopt the submission by our able learned friends representing the first accused. Our client is a junior civil servant earning less than Ksh.100,000 per month and consequences of him taking plea today means he is suspended from work and he will only receive half a pay. He is also a father and has obligation to his family.”

The Prosecution however argued that there was loss that has been occasioned to KPA and the fact that the amount was not fraudulently received by the first accused does not mean that money was not lost.
