Ex-MP Mark Toos burial to proceed after womans son accepted by family

A woman who had moved to court seeking to stop the burial of former nominated Member of Parliament Mark Too has withdrawn her suit.

Fatuma Ramadhan Hassan had filed the case through lawyer Danstan Omari, saying her son was sired by Too, thus should be recognised as a member of his family.

Ms Hassan further wanted the court to compel Too’s immediate family to include her son in the politician burial plans.

Danstan Omari said they took the decision to withdraw the suit as the concerns they raised in their suit papers had been addressed, revealing Fatuma’s teenage son “will be included in Too’s burial rites” and that “the boy’s school fees for the year will be paid by the former politician’s family”.

The teenager was allowed to attend Too’s requiem mass at AIC Church in Milimani on Friday morning.

Omari claims that a DNA test was ordered in 2012 when Hassan sued Too for support, and the result turned out positive. The late politician reportedly had been paying the boy’s school fees since then.

The lawyer of Too’s family, Tom Ojienda, had on Thursday expressed confidence that the suit would not stand in the way of Too’s burial.

The family, on Thursday, also made public the results of a post-mortem carried out on Too that showed he died from heart-related complications.

Too will be buried on Monday, January 9 in his Kapsaret home, which is situated in the outskirts of Eldoret Town.

He died on January 31, at the St. Lukes Hospital in Eldoret.

The late Too served as a nominated MP and Assistant Minister in President Daniel arap Moi’s regime.
