Families of children killed in Kajiado explosion awarded Ksh 11m

The High Court before Justice Mbogholi Msagha has awarded the families of five children who were killed in an explosion in Kajiado County in the year 2011 cash totaling to Ksh 11 million in damages.

While delivering the ruling, Justice Msagha maintained that the Ministry of Defence is accountable for the death of the children; Joel Sintamei, 5, Elijah Panai, 8, Isainya Sunkuya, 6, Boniface Meinsanka, 5, and Stephen Letuya, 7, who lost their lives on May 8, 2011 at Olmararoi village, Kajiado County.

It was alleged that the kids were taking their livestock home after a long grazing day when they came across mortar bomb and started to play with it.

The court noted that the bomb exploded a few kilometers from the Ministry of Defence training ground, the reason court concluded that the bomb belonged to them hence the liability.

KDF, however, has since denied responsibility and instead pointed fingers at the British government during the 2nd World War maintaining that the bomb was left lying there without being detonated.
