Father in court over custody of triplets

Two families are in court over the custody of four children, triplets and a teenager.

The biological father of the triplets who is also the step-father to his deceased wife’s 16-year-old daughter has moved to court to have orders denying him the custody of the children set aside.

Resident Magistrate Zipporah Gichana ordered that the custody of the children remain in the hands of their late mother’s siblings until next month when the case will be heard.

However, the magistrate gave the man unrestricted access to the children and permitted the teenager access to her step-father’s house.

According to the father, his wife, a former senior manager in an insurance firm died on October 4, 2017 just hours after a Cesarean delivery of the triplets.

The triplets were placed under Nairobi Hospital pre-mature unit section for 26 days until their discharge on October 30th.

Through the Ajaa Olubayi & Company Advocate, the woman’s siblings moved to court on November 18 and applied for custody of the triplets (two boys and one girl) as well as the 16-year daughter.

They argued that the biological father is a habitual drunkard with aggressive and violent behavior and is currently medically challenged as a result of a road accident therefore not fit to take care of the newborn triplets.

The father, however, opposed the application on grounds that the deceased left a will in which she appointed four of her siblings as executioners.

Resident magistrate Gichana fixed the matter to be heard early next Decmber.
