Ferdinand Waititu finally reappears in court for Ksh.588M fraud case

Former Kiambu Governor Ferdinand Waititu finally reappeared in court on Wednesday for the hearing of the Ksh.588M fraud case.

The case had hit a snag several times last year after his lawyers said he was admitted to hospital.

In December 2020, despite facing corruption-related charges, Waititu revealed plans to take part in the Nairobi by-election as an independent candidate.

Waititu told Citizen TV that he had presented his papers to the Independent Electoral and Boundaries Commission (IEBC).

However, the Ethics and Anti-Corruption Commission (EACC) later issued a statement barring Waititu and former Nairobi Governor Mike Sonko from holding public office.

EACC boss Twalib Mbarak cited Chapter 6 of the Constitution which states that a person is disqualified from appointment or election to public office if they have been dismissed or otherwise removed from office for contravention of the law.

On Wednesday, Waititu was seen in court following proceedings as the Prosecution presented its second witness in the case involving him and 12 others.

The Prosecution led by Senior Assistant DPP Joseph Riungu has lined up 69 witnesses.

The first witness–Dr. Justus Bundi (Director Supply Chain Management at Kiambu County) was presented on Tuesday.

According to the Office of the Director of Public Prosecution (ODPP), Dr. Bundi told the court that a new criteria was introduced in the tendering process to favor a bidder.

He said the evaluation committee added the criteria which favored Testimony Enterprises Ltd.

The Prosecution’s second witness–Faith Njeri (Kiambu’s Chief Finance Officer) was presented on Wednesday.

She told the court that Testimony Enterprises Ltd received Ksh. 147.2million as advance payment. The case continues.
