Fight against impeachment of Kirinyaga Governor Anne Waiguru hots up

Embattled Kirinyaga Governor Anne Waiguru has for the second time moved to court to challenge her impeachment.

In an amended petition, Waiguru is asking the court to suspend any resolution passed or made with regards to her impeachment.

She also wants the court to declare that impeachment proceedings that were initiated at the Kirinyaga County Assembly are null and void.

The Governor avers that the respondents ignored the April 7 temporary reprieve order from Justice Weldon Korir.

Justice Weldon Korir temporarily stopped her impeachment on grounds that the current COVID-19 pandemic will violate her constitutional rights to a fair hearing.

The Governor had also explained that she suffers from an existing condition that puts her at risk of severe effects should she be exposed to coronavirus.

She further noted that many offices were closed and she could not get documents to support her case.

Meanwhile, the Senate Speaker has received notification of the resolution by 23 Kirinyaga MCAs to have their Governor removed from office.

In a letter dated June 9, 2020, MCA Anthony Gathumbi conveyed the notification of the motion for grounds for impeachment of Kirinyaga Governor Anne Waiguru.

Experts aver that impeachment is a process and does not in itself constitute removal from office.

Once a Governor is impeached at the County Assembly level, a written communication regarding the vote should be officially handed to the Senate Speaker within two days.

During this time, the Governor continues to perform the county functions as the Speaker convenes a meeting to discuss the ouster bid.

The notice of application with regards to the impeachment of Kirinyaga Governor Anne Waiguru is to be heard on Thursday, June 11, 2020.

Respondents are listed as the County Assembly of Kirinyaga and the Speaker of the County Assembly of Kirinyaga.
