Former CMC director denies charges in fatal crash case

Former CMC Motors Limited Director Joel Kamau Kibe, who is accused of causing an accident at the UN barrier in Gigiri leading to the death of one security guard on Thursday presented himself before Principal Magistrate Benson Nzakyo.

Kibe who has been charged with three counts of causing death, causing injuries and driving under influence was released on a Sh100,000 cash bail with an alternative bond of Sh300,000 with surety of a similar amount.

Kibe who was expected in court on Wednesday was represented by his lawyer who told the court that his client had been taken to hospital after sustaining injuries on his ribs which led to him being put on bed rest for three days.

Kibe is reported to have crashed into a security barrier in Nairobi’s Runda Estate on Monday night and thereafter a video footage showing Kibe downplaying the fatal accident which left a night guard dead went viral on social media.

Going by the trail of destruction left behind at the scene, police say Kibe is lucky to be alive.

According to the deceased’s colleagues who work for the Chancery Security Group, the guard by the name Wachira was not supposed to be on duty but had come to stand in for his colleague who was not feeling well.

Elsewhere, the corruption case facing Former Transport CS Engineer Michael Kamau has been adjourned following his poor health condition.

Kamau who was Wednesday summoned to appear in person in court Thursday obeyed the orders but could not walk into the court room, forcing representatives of the court to meet him at the parking lot in his car after he was driven within court compound.

While granting the adjournment, Principal Magistrate Laurence Mugambi observed that Kamau was not able to support himself or seat upright following effects of a surgery he underwent in India and therefore is not able to stand the trial.

The former CS is charged with willful failure to comply with government financial regulations.

He is wanted in court to answer charges of abuse of office for irregularly awarding a Sh33 million tender for the redesigning of the Kamukuywa-Kaptama-Kapsokwony-Sirisia road in Western Kenya.

The case will be mentioned on 4th March 2016 to assess his health condition.
