Waithaka was arrested alongside former Water CEC Grace Wanjiru and former county officer Kahiu Gaiko.
Kahiu served as a director in the Department of Water, Energy, Environment and Natural Resources.
The three are currently at the Ethics and Anti-Corruption Commission (EACC) offices in Nyeri.

This comes just a day after an order was issued that the former Governor Waithaka Mwangi be charged alongside seven others for alleged involvement in a fraudulent Ksh.50million water and sewerage tender issued in 2014.
Director of Public Prosecution Noordin Haji said the officials will answer to charges of flouting procurement laws and regulations in awarding the tender.
Other charges include abuse of office, failure to comply with procurement laws and fraudulent acquisition of public property.
