Former suspects of 2010 Uganda bombings awarded Ksh.8M

The High Court in Nairobi on Wednesday awarded Ksh.8 million to three Kenyan citizens who were suspected of participating in the Uganda bombings in 2010.

The three; Mohamed Adan Abdow, Mohamed Hamid Suleiman and Yahya Suleiman were awarded the money as damages to cover all violations to their fundamental rights and freedoms.

In his ruling, Justice David Majanja said that the arrest and removal from Kenya to Uganda to face trial without extradition proceedings was a violation of their rights.

In 2010, the Kenyans sued the Attorney General, saying they were illegally arrested.

The suspects applied for a judicial review of the circumstances under which they were arrested and extradited to Uganda, saying due process of law was breached.

In their argument, the suspects said that no extradition proceedings were ever undertaken against them before any lawful court of competent jurisdiction in the Republic of Kenya.
