The Supreme Court on Friday nullified the election of Julius Mawathe as Embakasi South Member of Parliament.
This follows a successful petition by Former Embakasi South MP Irshad Sumra that cited malpractices, irregularities and illegalities committed during the August 8, 2017 poll.
In his argument, Sumra further faulted the electoral body, IEBC for his loss saying the returning officer had declared the wrong winner.
In July, 2018, the appellate court had also reversed High Court’s decision declaring Julius Mawathe Musili as the Embakasi South Member of Parliament.
While nullifying the election, the Court of Appeal noted that the election was not held in accordance with the law.
Court of Appeal Judges; Daniel Musinga, Mohammed Warsame and Kathurima M’inoti directed IEBC to conduct fresh elections in accordance with law.
