Garissa University terrorist attack case resumes

Garissa University terrorist attack case will now be heard on February 15, after complaints by prosecution that Safaricom are non compliant were settled.

In the settlement, Safaricom limited officers apologised to court citing for the communication breakdown and promised to comply with the court to fast track the trial of the case.

Prosecution counsel Dancun Ondimu had castigated Safaricom officers for not willing to produce a data expert witness to testify in the matter. This led to Safaricom acting MD being summoned to explain why the company has failed to avail a witness in a case where four men are linked to 2014 Garissa University terrorist attack.

Chief Magistrate Francis Andayi had also summoned the company’s liaison officer Inspector Raballa and superior liaison officer Weldon Siongok who appeared in court.

Director of Public Prosecution had also accused the telecommunications giant of sabotaging trial of the case and treating the criminal matter casually despite of the seriousness of it.

In the case, five suspects had been charged with committing terrorist acts, harboring a terrorist and being in the country illegally.

The suspects are a Tanzanian National Charles Mberesero, Mohamed Ali Abdikar, Hassan Aden Hassan, Sahal Diriye and Osman Abdi, who are alleged to be Kenyan and Somali nationals.

The five are also accused of involvement in terrorist activities at Garissa University in North Eastern on April 2, 2015 that led to death of 148 people.
