Governor Nyong’o ordered to include nephews, nieces in family estate

The High Court in Kisumu on Thursday ordered Governor Anyang’ Nyong’o to include his nephews and nieces as beneficiaries of his father’s Ksh.200 million estate.

High Court Judge Tripsisa Cherere revoked the administrative letters and certificate of confirmation of grant that placed Prof. Nyong’o and his sister Risper Nyagoy as the sole controllers of the estate.

Justice  Cherer also appointed one of Governor Nyong’o’s nephews, Kenneth Odhiambo Okuthe, as co-administrator of the deceased’s estate.

The county chief’s father Hesbon Shimei Nyong’o died on November 10, 2006 without a will. Mr. Okuthe and Geoffrey Omondi later sued Prof. Nyong’o and Ms. Nyagoy for leaving out some relatives in the list of beneficiaries of the estate.

They said the governor and his sister were made the administrators of the estate after the local chief certified that the two and their mother and other siblings were the true beneficiaries.

They further accused the two of neglecting the children of their late sisters Margaret Awuor and Judith Nyong’o. Mr. Omondi is the eldest son of Judith Nyong’o, now deceased, while Mr. Okuthe is the late Margaret Owuor’s son. The two were brought up by their grandfather, Mr. Shemei following the death of their mothers.

The property under contention includes 100 acres of land in Miwani and land and flats along Jogoo Road in Nairobi. Others are parcels of land in Manyatta, Tamu, Milimani estate and East Rata in Seme sub-county, Kisumu County.

Justice Cherere says she was satisfied that the petitioners were entitled to property of the deceased and that the grant that gave Prof. Nyong’o and Ms. Nyagoy control of the multi-million-shilling property was obtained illegally.

She also directed the three appointed administrators – Prof. Nyong’o, Ms. Nyagoy and now Mr. Okuthe – to apply for the confirmation of the grant within 60 days after ascertaining all persons and their respective entitlement of the property.
