Govt to appeal disbandment of Communication Authority Board

The government has said that it will appeal against the High Court ruling which disbanded the Communications Authority of Kenya board.

ICT Cabinet Secretary Fred Matiang’i said that the government will appeal against the ruling by Justice George Odunga through the Attorney General arguing that the process of appointing the CAK board followed the law.

Speaking during a technology forum at a city hotel, Matiang’i said that he appointed members to the CAK board after receiving their names from a selection panel.

Justice Odunga last week quashed the gazette notice on the appointment of seven members of the CAK panel for being conducted outside the statutory timelines in a case filed by the Secretary General of the ICT Association of Kenya.

The High Court ruling renders the contentious decisions made by the board in relation to the digital migration and the thin SIM technology among others open for review.

The Constitution provides for the establishment of a body, which will be independent of control of government, political interests or commercial interests.
