High Court Bars Senate from Summoning Governors

While delivering the ruling, Justice Mumbi Ngugi issued the orders pending the hearing and determination of a petition filed by the international legal consultancy group.

 

Justice Mumbi has also referred the case to the Chief Justice to constitute a bench of judges to hear the matter.

 

The 9 governors had been summoned by the Senate over queries in their respective governments' finances.

 

This case come after a report by the Auditor General indicated that many governors could not account for the use of hundreds of millions of shillings allocated to their counties, with a huge chunk of their funds having been used on questionable dealings.

 

The Auditor General Edward Ouko also expressed concerns over how county governments are managing funds.

 

Ouko added that there was a serious misappropriation and misuse of funds in some counties.

 

The governors however argue that the Senate has no powers to summon them over county finances.

 

The council of governors is also seeking advisory from the Supreme Court over the same.
