High Court declines to stop probe of Governor Mutua

The High Court, before Justice Joseph Onguto, has declined to issue a ruling reinstating previous orders that had halted Machakos Governor Alfred Mutua’s probe.

Justice Joseph Onguto denied the governor’s petition saying he cannot interfere with the case since is being handled by a different Judge who is on vacation.

Machakos Governor Alfred Mutua had moved to court again to stop his prosecution over procurement of motor vehicles after an order barring probe was lifted.

In a petition filed in court, Governor Mutua said that his rights to hold office were likely to be infringed without justification if prosecution went ahead, saying he is likely to be arrested and charged.

Mutua had argued that public officers who participated in the tendering and purchase of motor vehicles had already been charged in court with various offences.

The case will be mentioned on January 12, 2016.
