High Court refers Omtatah case over image in new currency to CJ

The High Court has requested Chief Justice David Maraga to form a three-judge bench to hear ‘weighty’ issues in the case seeking to stop issuance of the new currency notes.

This is after Justice Weldon Korir said the matters raised in the petition raise substantial questions of law.

Okiya Omtatah, an activist, filed a second petition challenging the new currency unveiled on Saturday, June 1 by President Uhuru Kenyatta.

“It is a lie that the currency was issued vide the Gazette Notice of 31st May 2019 as no such gazette notice exists at the Government Printer.

“A copy of the Kenya Gazette published on May 31, 2019 does not contain a notice issuing the currency,” he argues.

He is also challenging the inclusion of a portrait of founding President Jomo Kenyatta on the new currency notes.

He further says that the demonitization of the Ksh.1,000 notes after October 1 is not supported by law.

In the first petition that was filed by East Africa Legislative Assembly (EALA) MP Simon Mbugua, the directive was termed as illegal and unconstitutional.

According to him, the new notes violate provisions of Article 231(4) of the Constitution and were apparently executed without public participation.
