Civil society, JSC enjoined in case on CJ appointment

Five human rights organisations together with the Judicial Service Commission have been enjoined as interested parties in a case where LSK is seeking to stay the implementation of Section 30(3) of the Judicial Service Act.

The amended Act requires JSC to submit to the president three names for appointments to the position of chief justice or deputy chief justice.

Kenya’s Section of the International of Jurists and Kituo cha Sheria have been enjoined as friends of the court and will be allowed to submit on matters of the law only and not facts of the case.

Justice Isaac Lenaola has directed that the matter be heard on 22nd January stating that there is no need to grant any interim orders to suspend the act.

At a joint press conference at Milimani Courts Building, the human rights organisations have condemned the amendment of the JSC Act citing it is a blatant violation of the Constitution as it infringes on the independence of the JSC and the judiciary hence violating the Kenyan Constitution.
