High Courts Halts Prosecution of Kidero,Shebesh

In his ruling, Justice Isaac Lenaola issued a 7 day ultimatum for the two to enter dialogue and resolve the matter out of court

 

Justice Lenaola further directed the Director of CID to arraign the two in Court if they fail to reconcile.

 

The case will come up for mention on the 13th January to confirm compliance.

 

The case was filed by a voter Alex Ochako who sought to bar the prosecution of Nairobi County Governor Dr. Evans Kidero for allegedly assaulting women representative Rachael Shebesh.

 

Ochako, through lawyer Evans Ondieki argued that the planned prosecution of Kidero as ordered by the DPP Keriako Tobiko is in bad taste and will deter him from performing his official duties.

 

Ochako also named the Attorney General and Director of Public Prosecutions, as respondents.

 

Ochako moved to court just a day after Tobiko directed the CID department to initiate charges against the Nairobi County Governor for allegedly slapping Shebesh in September 2013.

 

Nairobi Women Representative Rachael Shebesh is also facing charges of causing disturbance that is likely to disrupt public peace

 

Kidero is alleged to have slapped Shebesh last year when she stormed City Hall with Nairobi county workers who had gone on strike.
