Homa Bay MCAs rearrested for assault freed on Ksh.50K bond

Two Homa Bay MCAs pleaded not guilty to charges of physically assaulting and injuring a court server a week ago.

Julius Odhiambo Gaya (Central Karachuonyo) and Philemon Onyango Onditi (Kagan) denied assaulting David Elvis Ochieng who had gone to serve court papers at the assembly.

Appearing before the Kisumu Principal Magistrate Christopher Yalwala, the two MCAs, who were represented by Advocate Aggrey Mwamu, requested for release on bond.

Mwamu told the court that the two have to attend assembly sessions and pleaded with the court to grant them bail.

Prosecutor Lazarus Sirtui did not object to the request but reminded them that they would not get any special treatment.

Yalwala directed that the duo be released on a Ksh.20,000 cash bail and Ksh.50,000 bond each as well as a surety of similar amount.

The Magistrate further ordered that the matter be mentioned on November 30 alongside another case involving five other MCAs accused of assaulting the Homa Bay County Assembly Speaker.

The court further set January 24, next year as the hearing date.

The MCAs were re-arrested on Tuesday evening after spending five nights at the Kodiaga Maximum Prison with their co-accused.
