Homa Bay residents in court seeking prosecution of Governor Awiti

Two residents of Homa Bay County have filed a suit in the High Court seeking to compel the Ethics and Anti-Corruption Commission (EACC) to institute criminal charges against Homa Bay Governor, Cyprian Otieno Awiti.

The two petitioners, Michael Kojo Otieno and Samora Machel Alosi, claim massive financial impropriety by Awiti and some county executives.

They argue that 100,000 shillings was allegedly used to transport sports equipment goods from Nairobi Sports House, saying that no such sports equipment was bought or transported.

“In relation to the renovation of HomaBay Stadium, in the 2013-2014 financial year, the amount allocated for the said works does not reflect the amount of work done and it is clear that money was lost in the project even though the exact amount is not known,” reads the petition.

The petition further alleges substandard, ghost, and fake projects in which the public had lost billions of shillings.

The projects include water projects, roads, hospitals and sports.

The two petitioners wants the court to compel the respondents to register all the assets of the county and to account to all the funds as indicated in the constitution and further a declaration that the respondents have engaged in corrupt practices amounting to a gross violation of the constitution and have been rendered incapable of discharging their mandate as required by the constitution.

The suit filed before a High Court in Homa Bay, has been certified urgent and inter-pates hearing date set for March 21, 2017, before Lady Justice, H. A Omondi J.

County Executive for Transport, Nicholas Koriko, County Executive for Water, Beatrice Akinyi Ogola, Dorothy Okelo for Tourism, and County Secretary, Isaiah Ogwe, have been named as respondents in the suit.

Ethics and Anti-Corruption Commission, and the Attorney General have also been named in the petition.
